An ADU (Accessory Dwelling Unit) is a second home built on a property that has its own kitchen, bedrooms, and bathroom. The lot size must be a minimum of 3,500 sq ft and not in a planned community development or part of an association.

Home owners with lots of 3,500 to 4,999 sq ft can build a unit up to 400 sq ft while owners with 5,000 or more sq ft can build a unit up to a 800 sq ft.

ADU Considerations

The City and County of Honolulu recently passed a law that allows Oahu homeowners to build an accessory dwelling unit (ADU) on their property if they meet certain criteria. An ADU is a simple concept allowing for a second small dwelling to be built on the same property (attached or unattached) to a single-family home.

Here in Hawaii, homeowners who choose to add on to their property can do so via the new law. ADUs provide homeowners with opportunities to gain income and create additional property value while also helping to quell the demand for housing and rental units in Hawaii.

Though many people buy houses and live in them for decades, their actual needs change over time. Often, adult children return home or aging parents come to live with family. However, the way homes are currently built does not reflect those changing needs.

The benefits gained by homeowners after adding an ADU range from generating supplemental income to providing extra space for family to live in and adding value to the overall property. ADUs also provide an alternative means of expanding the range of dwellings available in a tight housing market.

When considering whether to take advantage of the new Accessory Dwelling Unit changes to the building and permitting of ADU’s on single-family home lots, be sure to review the requirements below.  If you can YES to all of these questions – then an ADU may be exactly what you are looking for.

  1. Is your lot is zoned R-3.5, R-5, R-7.5, R-10, R-20 or Country District?

  2. Is your lot is at least 3,500 SF?

  3. Your lot cannot be landlocked.

  4. Does your lot consist of only one single-family dwelling?

  5. Will you, your family or a designated authorized representative be occupying either the main dwelling or the ADU?

  6. All covenants running with the land will be filed with the Bureau of Conveyances or the Land Court of the state of Hawaii, or both?

  7. Is your lot is able to fit one parking space in addition to the parking required for the primary dwelling unit? (No parking is required if the lot is located within one-half mile of a rail transit station)

  8. Is your lot at least 3,500 SF? 
    a.  3, 500 – 4,999 SF lot allows a maximum floor area of the ADU to be a maximum of 400 SF. Or if your lot is 5,000 SF or greater the maximum ADU floor size is 800 SF.
